1. Service
Offshore VPS Hosting⁺ is a VPS and VDS hosting service operated by NextVision Media.
The service provides virtual server and dedicated-class infrastructure for websites, applications, development, private services, and other lawful workloads.
2. Account
Users are responsible for providing accurate account information and maintaining the confidentiality of their login credentials.
Users are responsible for all activity performed through their account.
3. Payments and Pricing
All prices are displayed before an order is placed.
For the Starter plan:
- The introductory price is $9.99 for the first month.
- After the introductory period, the regular price is $19.99 per month.
- The $9.99 introductory price applies only to the first eligible month.
- If the subscription is not cancelled at least 7 days before the end of the current billing period, the service may automatically renew at the regular renewal price.
The applicable price and renewal conditions will be displayed before payment or order confirmation.
4. Cancellation
Users may cancel their service according to the cancellation options provided by the service.
Cancellation does not automatically entitle the user to a refund for a period already paid for, except where required by applicable law or expressly stated by NextVision Media.
5. Acceptable Use
The service may only be used for lawful purposes.
Users must not use the service for activities that violate applicable laws, infringe the rights of others, abuse or attack third-party systems, distribute malware, conduct fraud, or otherwise create unreasonable risks to the service, its infrastructure, or other users.
NextVision Media may suspend or terminate services where necessary to protect its infrastructure, other users, or comply with legal requirements.
6. Suspension and Termination
NextVision Media may suspend, restrict, or terminate a service or account if:
- the user violates these Terms;
- the user's activity creates a security or operational risk;
- the user fails to pay applicable charges;
- the service is used for unlawful or prohibited activity; or
- suspension or termination is reasonably necessary to protect the service, infrastructure, or other users.
Where appropriate, NextVision Media may take action without prior notice when immediate action is reasonably necessary.
7. Service Availability and Maintenance
The service is provided on an ongoing basis, but uninterrupted availability cannot be guaranteed.
Maintenance, infrastructure problems, network problems, upstream provider issues, security incidents, force majeure events, or other circumstances beyond the reasonable control of NextVision Media may affect service availability.
NextVision Media is not responsible for losses caused by interruptions or degradation that are outside its reasonable control.
8. Data and Backups
Users are responsible for maintaining appropriate backups of their own data.
NextVision Media does not guarantee that user data will always be recoverable after hardware failure, software failure, accidental deletion, security incidents, service termination, or other events.
9. Resource Usage
Users must operate their services within reasonable resource limits and must not intentionally abuse shared infrastructure or interfere with the operation of other services.
Where excessive or abusive resource usage materially affects infrastructure or other users, NextVision Media may restrict or suspend the affected service.
10. Security
Users are responsible for securing applications, operating systems, passwords, and other software installed on their servers.
NextVision Media is not responsible for security problems caused by software, configuration, credentials, or actions under the user's control.
11. User Responsibility and Indemnification
Users are responsible for their use of the service and for any claims, losses, damages, liabilities, costs, or expenses arising from their unlawful use of the service, violation of these Terms, or infringement of third-party rights.
To the extent permitted by applicable law, users agree to indemnify and hold harmless NextVision Media from such claims, losses, damages, liabilities, costs, and expenses.
12. Disclaimer
The service is provided on an "as available" basis.
To the maximum extent permitted by applicable law, NextVision Media makes no warranties regarding uninterrupted availability, suitability for a particular purpose, or the absence of errors or interruptions.
13. Limitation of Liability
To the maximum extent permitted by applicable law, NextVision Media shall not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of the service.
To the maximum extent permitted by applicable law, the total liability of NextVision Media arising from or related to the service shall not exceed the amount paid by the user for the affected service during the three months preceding the event giving rise to the claim.
14. Force Majeure
NextVision Media shall not be liable for failure or delay caused by events beyond its reasonable control, including natural disasters, war, government actions, major network failures, infrastructure failures, cyber incidents, power failures, or failures of upstream providers.
15. Refunds
Refund eligibility is determined according to the applicable service and payment terms displayed at the time of purchase.
Nothing in these Terms excludes any refund or consumer right that cannot lawfully be excluded.
16. Intellectual Property
The website, branding, logos, text, graphics, and other materials provided by NextVision Media remain the property of NextVision Media or their respective rights holders unless otherwise stated.
Users receive no ownership rights in such materials merely by using the service.
17. Third-Party Services
The service may rely on third-party infrastructure, payment providers, networks, software, or other external services.
NextVision Media is not responsible for failures or changes originating from third-party services outside its reasonable control.
